appropriative rights

An appropriative right is generally based upon physical control and beneficial use of the water.

If your land does not abut (or, is not riparian to) a stream or one of its tributaries, and you do not fall within one of the two exceptions, you cannot have a riparian right, and you need to consider whether you might have an appropriative right.
